These Terms govern the use of the corporate website of Apex Management GP Ltd. (the “Website”).

By using the Website, the user confirms that they have read these Terms. If the user does not agree with them, use of the Website is discontinued.

Apex Management GP Ltd. is regulated by AFSA. Licence No. AFSA-A-LA-2023-0009 has active status; the permitted activity includes Managing a Collective Investment Scheme in respect of Exempt Funds.

• using the Website to distribute malicious code, spam, fraudulent or unlawful materials;
• impersonating another person or misleading the Company as to identity or authority;

Matters governed by AIFC law are considered in accordance with the Constitutional Statute of the Republic of Kazakhstan “On the Astana International Financial Centre” and applicable AIFC Acts.

For matters not regulated by applicable AIFC Acts, and where mandatory legislation of the Republic of Kazakhstan applies, the relevant provisions of the legislation of the Republic of Kazakhstan apply.

Disputes are considered by the competent court or other authority in accordance with applicable jurisdictional rules.

The AIFC Court has jurisdiction in cases established by the Constitutional Statute on the AIFC, applicable AIFC Acts or agreement of the parties. These Terms do not by themselves extend the jurisdiction of the court beyond the limits provided by applicable law.

The Website may be published in Russian, English and Kazakh. The Company seeks to ensure substantive equivalence of the translations.

For regulated, contractual or offering documents, language priority is determined by the relevant document itself and applicable law; this English web version does not alter such priority.
